These Membership Terms and Conditions ("Terms") apply to all members of Spartan Combat Sports LLC (the "Gym"). By enrolling as a member, you agree to abide by these Terms.
1. MEMBERSHIP ELIGIBILITY
Membership is open to individuals aged 18 or older. Minors under the age of 18 must have a parent or legal guardian complete the membership registration and sign any required waivers.
Members must complete and sign the Membership Waiver and Release of Liability before participating in any activities.
2. MEMBERSHIP PLANS AND FEES
Members must choose a membership plan and agree to pay the associated fees as outlined at the time of registration.
Membership fees are non-refundable, except as required by law.
One-Time Payment Option: Members may choose to make a one-time payment for a fixed-term membership plan. This payment will cover the full membership term and is non-refundable.
For recurring membership plans, monthly fees will be auto-deducted from the payment method on file unless the membership is canceled in accordance with Section 6.
By selecting a membership plan with recurring payments, members explicitly authorize Spartan Combat Sports LLC to charge their designated payment method at the agreed-upon intervals (e.g., monthly). This authorization will remain in effect until the membership is canceled in accordance with these Terms.
Members are responsible for maintaining accurate and up-to-date payment information on file.
Failed payments may result in suspension of membership access until the outstanding balance is resolved.
3. GYM RULES AND CONDUCT
All members agree to:
Respect Safety Policies:
- Use equipment as instructed and only in designated areas.
- Wear appropriate attire, including protective gear, for training and sparring sessions.
- Immediately report any injuries or unsafe conditions to Gym staff.
Maintain Respectful Conduct:
- Respect the rights of staff and fellow members.
- Refrain from any form of harassment, violence, or abusive behavior.
- Avoid bringing alcohol, illegal substances, or weapons into the Gym.
Follow Instructions:
- Comply with the directions of instructors and staff at all times.
- Participate in classes and activities only if medically and physically fit to do so.
Failure to comply with these rules may result in suspension or termination of membership without refund.
4. FACILITY ACCESS AND OPERATING HOURS
Members may access the Gym during regular business hours as posted.
Spartan Combat Sports LLC reserves the right to modify operating hours, close for holidays, or temporarily suspend operations for maintenance or events with advance notice to members.
5. MEDICAL DISCLAIMER
Members are responsible for ensuring they are in proper health to participate in Gym activities.
Spartan Combat Sports LLC is not liable for any injuries, illnesses, or medical conditions arising from participation unless caused by gross negligence or willful misconduct by the Gym.
6. MEMBERSHIP CANCELLATION AND TERMINATION
Month-to-Month Membership (M2M): Members may cancel their M2M membership at any time with 30 days' advance written notice.
Fixed-Term Membership (Term): If a membership has a fixed initial term, members must provide written notice of cancellation at least 30 days prior to the end of the initial term. Term memberships will automatically roll over into a month-to-month membership ("Evergreen Status") unless canceled with proper notice.
Members must submit written cancellation notices via email.
Spartan Combat Sports LLC reserves the right to terminate a membership for violations of these Terms or disruptive behavior. No refund will be issued for terminated memberships.
Recurring dues billing will begin as detailed at the time of enrollment and will continue on the same day each month thereafter.
7. LIABILITY AND INDEMNITY
Members understand and accept the risks associated with participation in combat sports and related activities.
Spartan Combat Sports LLC shall not be liable for personal property damage, theft, or loss incurred on the premises.
Members agree to indemnify and hold harmless Spartan Combat Sports LLC from any claims, damages, or liabilities arising from their actions or conduct.
8. PHOTO AND VIDEO CONSENT
Members grant Spartan Combat Sports LLC permission to use photographs or videos taken during training for promotional purposes unless they provide written notice to opt out.
9. CHANGES TO TERMS AND MEMBERSHIP FEES
Spartan Combat Sports LLC reserves the right to update these Terms or adjust membership fees with at least 30 days' notice to members. Members will be notified of any fee changes via email to the email address on file. Members who do not agree to the updated Terms may cancel their membership without penalty.
10. GOVERNING LAW AND DISPUTES
These Terms shall be governed by the laws of California.
Any disputes arising from these Terms will be resolved in the courts located in San Mateo County, California.
Dispute Resolution: Any disputes, except claims for personal injury or small claims, shall first be addressed through informal discussions, followed by non-binding mediation. If unresolved, disputes shall proceed to binding arbitration under the American Arbitration Association (AAA).
Members waive their right to class action claims.
11. MEMBERSHIP WAIVER AND RELEASE OF LIABILITY
IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING.
I, the undersigned member (or parent/guardian if the member is a minor), acknowledge and agree to the following:
Assumption of Risk: I understand that participation in combat sports, training sessions, and related activities at Spartan Combat Sports LLC involves inherent risks, including but not limited to physical injury, illness, or death. I voluntarily assume all risks associated with my participation.
Release of Liability: I hereby release, waive, discharge, and covenant not to sue Spartan Combat Sports LLC, its owners, employees, instructors, agents, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may occur while participating in Gym activities or using Gym facilities, whether caused by negligence or otherwise.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, or expenses (including legal fees) arising from my participation in Gym activities.
Medical Treatment: In the event of an injury or medical emergency, I authorize Spartan Combat Sports LLC to obtain medical treatment on my behalf. I understand that I am responsible for any medical costs incurred.
Acknowledgment of Fitness: I affirm that I am in good physical condition and have no known medical conditions that would prevent me from safely participating in Gym activities.
Understanding of Document: I have carefully read this waiver and fully understand its terms. I sign it voluntarily and without any inducement.

Consent to Auto-Renewal and Preauthorized Payments
I understand and agree to the recurring billing terms as detailed above.
I authorize Spartan Combat Sports LLC to charge my designated payment method on a recurring basis for membership dues, fees, and applicable charges. (All references to "I" or "me" in this section shall refer to you.) By signing below, I am authorizing Spartan Combat Sports LLC to initiate payments, transfers, whether by EFT or ACH transfer, from the designated bank account tied to this Agreement for purposes of paying, on a recurring basis, all or a portion of the dues, fees, and charges which I owe under the Agreement. I understand and agree that: (a) dues, fees, and charges include, but may not be limited to, enrollment fees, membership dues, service charges, late fees, applicable taxes, and/or fees for uncollected monthly dues; (b) Spartan Combat Sports LLC may transfer funds from my designated account for any retail transactions or online purchases initiated by me.
